Official Rules: Dr. Oz's Biggest Fan

No Purchase Necessary TO ENTER OR WIN. A Purchase WILL NOT INCREASE YOUR Chances Of Winning.   Promotion is open only to legal residents of the United States. Must be 18 years of age or older to enter. Employees [and their immediate families (including parent, child, spouse or sibling and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related] of ZoCo Productions, Inc., Harpo Inc. and Sony (collectively, the “Sponsors”), and their respective parents, affiliates, subsidiaries and advertising and promotion agencies are not eligible to enter or win.  By participating, entrants agree to be bound by these Official Rules and the decisions of the judges and/or Sponsors, which are binding and final on matters relating to this Promotion.  Promotion is subject to all applicable federal, state and local laws.

The Promotion begins at 12:01 a.m. Eastern Time (“ET”) on October 14, 2010 and ends at 11:59 p.m. ET on October 20, 2010 (“Promotion Period”).  To enter, you must submit an essay of one thousand five hundred (1500) words or less describing why you consider yourself Dr. Oz’s Biggest Fan. If your essay is selected by our panel of judges and producers (collectively, the “Panel”), you could be chosen to come to New York to be in our studio audience. All essays must be submitted online at www.DoctorOz.com (“Website”). Click on the “Are You Dr. Oz’s Biggest Fan” Promotion and complete all of the required information and follow all instructions to submit the official entry form. Mail-in essay submissions will not be accepted or returned.  Limit one (1) entry per person/email address per household per day.  All entries must be received by 11:59 p.m. ET on October 20, 2010 to be eligible. Entries received after the deadline will not be considered. Entries generated by script, macro or other automated means are void.  All essay entries become the property of Sponsors and will not be acknowledged or returned.  By submitting an essay, each entrant represents and warrants that they own the copyright in and to such essay and further grants Sponsors the non-exclusive right to use that essay (or any portion thereof) for unlimited runs, worldwide, in perpetuity in any and all media now known or hereafter devised in connection with the Promotion and/or the “Dr. Oz Show” or any other programming (including television, digital download, radio) created by Sponsors and the marketing, advertising and promotion thereof.

SELECTION:  On October 21, 2010, the Panel will select, at its the sole discretion, from all eligible essay entries received, eight (8) winning essays (each a
”Winning Essay”).  Odds of being selected depend on the number of eligible entries received.  Potential Winning Essay entrants will be notified by phone, or email and may be required to execute and return an affidavit of eligibility, proof of identity, a liability release and, where lawful, a publicity release within twenty-four (24) hours of notification. If such documents are not returned within the specified time period, the Prize or Prize notification is returned as undeliverable, potential Winning Essay entrant is not in compliance with these rules, or Sponsors are unable to contact a potential Winning Essay entrant within the designated time period, Prize will be forfeited and, at Sponsors’ sole discretion, an alternate Winning Essay may be selected. 

 

Prize: Prize includes a trip (“Trip”) for each Winning Essay entrant (each a “Recipient”) to travel to New York, New York to attend a special taping of “The Dr. Oz Show.”  At the sole discretion of Sponsor and provided Recipient’s principal residence is more than one hundred (100) miles from New York, NY, the trip may also include roundtrip coach class transportation by air, train, bus or car from a major city closest to Recipient’s principal place of residence to New York; hotel accommodations (room and tax only) for up to two (2) days/one (1) night; and ground transportation while in New York City. All matters with respect to the Recipient’s mode of transportation, hotel accommodations and ground transportation shall be determined and selected by Sponsor in Sponsor’s sole discretion.  Recipient must be available and willing to travel to New York, New York on October 26, 2010 and to attend a special taping of “The Dr. Oz Show” on October 27, 2010. Sponsor is only responsible for booking return transportation following the taping on or about October 27, 2010.  The Trip is provided to the Recipient only. Sponsor is not responsible for booking travel, hotel accommodations, ground transportation or tickets to “The Dr. Oz Show” taping for any guest(s) accompanying the Recipient to New York. Travel is based on availability, blackout dates apply and some carrier and hotel restrictions may apply.  Trip details and show taping are subject to change.  (Approximate Retail Value (“ARV”) of the Trip is $1,500.00 US) depending upon the Recipient’s principal place of residence). Recipient is solely responsible for all expenses, costs or fees associated with acceptance and/or use of the prize not specified herein as being awarded including, without limitation, any and all taxes, transportation, food, gratuity and hotel charges.  Recipient may not substitute, assign or transfer prize, but Sponsors reserves the right, at their sole discretion, to substitute a Prize with one (1) of comparable or greater value.  Prize is awarded “as is” with no warranty or guarantee, either express or implied by Sponsors. Prize details are at Sponsors’ sole discretion. Limit one (1) Prize per person/email address per household for the entire Promotion. 

General Conditions: Released Parties (as defined below) are not responsible for lost, late, incomplete, inaccurate, stolen, delayed, misdirected, undelivered or garbled entries or email; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the Promotion, the processing of entries, the announcement of the prizes, or in any Promotion-related materials.  Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion.  Released Parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Promotion or downloading materials from or use of the website.  Persons who tamper with or abuse any aspect of the Promotion or website or who are in violation of these Official Rules, as solely determined by Sponsors, will be disqualified and all associated entries will be void.  Should any portion of the Promotion be, in Sponsors’ sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsors, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsors reserve the right at their sole discretion to suspend, modify or terminate the Promotion and, if terminated, at their discretion, select the potential Recipients from all eligible, non-suspect entries received prior to action taken.  Entrants, by participating, agree that Sponsors, and their respective parents, affiliates, subsidiaries and advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”) will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in this Promotion.  Recipient, by acceptance of Prize, excepts where legally prohibited, grants permission for Sponsors and their respective designees to use his/her name, address (city and state), photograph, voice and/or other likeness and Prize information for advertising, trade and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval. In the event of a dispute regarding entries received from multiple users having the same email account, the authorized subscriber of the email account at the time of entry will be deemed to be the entrant and must comply with these rules.  Authorized account subscriber is the natural person who is assigned the email address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any entrant and Sponsors, shall be governed by, and construed in accordance with the laws of the State of Illinois, without giving effect to any choice of law or conflict of law rules or provisions (whether of Illinois or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Illinois.  The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision.  In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

DISPUTES: As a condition of participating, entrant agrees that a) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, consequential, or any other damages, other than for actual out of pocket expenses, if any, and b) all causes of action arising out of or connected with this Promotion, or any compensation or credit to be provided, shall be resolved individually, without resort to any form of class action; and c) any and all claims, judgments, and award shall be limited to actual out of pocket costs incurred, if any, and in no event shall entrant be entitled to receive attorneys’ fees or other legal costs or expenses.

Recipient ListING: To obtain the name of all Winning Essay Recipients(available after October 21, 2010), send a self-addressed, stamped envelope to the “Are You Dr. Oz’s Biggest Fan Promotion” Recipient List c/o ZoCo Productions, LLC 30 Rockefeller Plaza 43rd Floor, New York, New York 10112 for receipt no later than January 1, 2011.  Sponsors have sixty (60) days to process your request after receipt.
